Five states have their own state disability insurance programs (SDI) that provide partial wage replacement for workers unable to work due to non-work-related illness or injury.
In these five states, workers are automatically covered through payroll deductions. If you become disabled, you file a claim with the state disability program — not your employer. You can often use state disability and FMLA at the same time — state disability provides income replacement, FMLA provides job protection.
The remaining 45 states do not have state disability insurance programs. Workers in those states may be able to use accrued sick leave, vacation, or short-term disability insurance through a private employer. Check your employee handbook or ask HR.
